In the USA, YOU have RIGHTS...

In the United States of America, every person has rights, regardless of their immigration (legal, illegal) status. These rights, YOUR rights include, especially as they relate to immigration status, dealing with immigrations agents...The right to due process, the right to an attorney, the right to remain silent, the right to be free from unreasonable searches and seizures...

Right to Remain Silent: You have the right to remain silent about anything you don't want to say to the police, or ICE agents. You do NOT have to talk to agents (ICE) about your immigration status or the immigration status of others. They may ask you to provide immigration documents, but you don't have to answer any questions. Anything you say can be used against you in immigration court

​

Right to an attorney: You have the right to speak with a lawyer and to have them present during questioning. This means you don't have to speak to law enforcement or ICE agents or sign anything without an immigration lawyer by your side

​

Right to due process: Includes the right to be informed of charges, the right to an attorney, and the right to present evidence 

​

Right to deny entry: ICE cannot enter your home or private workspace without a judicial warrant signed by a federal or state judge or your explicit consent. Administrative warrants, issued by ICE, are NOT signed by judges and do not grant entry

​

Right to be free from unreasonable searches and seizures: ICE agents or police cannot search your property or belongings without a warrant or probable cause. You have the right to refuse consent to a search

​

Right to Record: ·You have the right to record your interaction with anyone including immigration agents.

​

Right to ask for ID: Always ask anyone claiming to be from law enforcement for their identification. If they do not have identification, you do NOT have to speak to them, or answer any questions

​

Right to Leave: Ask if you can leave. If an ICE agent is questioning you on the street, ask them if you're free to go. If they say yes, walk away calmly. If they say no, you have the right to politely decline to answer questions and state you want to speak to a lawyer, even if you do not have a lawyer.

Remember! You have RIGHTS...

If ICE comes to your home...

  1. Remain calm and keep the door closed. Speak through the door or a window.

  2. Request to see their Identification

  3. Request to see a warrant. 

  4. Check the warrant and make sure it a validly signed warrant.

  5. Do not grant entry unless agents present a judicial warrant. 

  6. Remain silent if you choose, because this is your right.

  7. Record if you want to. It's your right.

If ICE comes to your work...

  1. Do not panic and do not run away. If you are frightened and feel like you need to leave, you can calmly walk toward the exit. 

  2. You have the right to remain silent. You do not need to speak to the immigration authorities or answer any questions.

  3. You have the right to speak to a lawyer. If you are detained or taken into custody, you have the right to immediately contact a lawyer.

If ICE on the street...

  1. You have the right to ask for identification

  2. You have the right to remain silent

  3. Ask if you are free to leave: If the ICE agent says no, you can politely decline to answer questions and state you want to speak to a lawyer. 

  4. You don't need to have a lawyer to ask for one.

  5. ​Do not consent to any searches

  6. Do not provide false information

  7. Stay calm, don't panic or try to run.
